Mark LeHocky is a mediator and arbitrator with ADR Services, Inc., who previously served as general counsel to Dreyer’s Grand Ice Cream, Inc. and Ross Stores, Inc. Prior to his general counsel days, he spent twenty years litigating commercial, IP, antitrust, class action and other disputes for clients ranging from small businesses to Fortune 100 companies and began mediating over two decades ago. He has been repeatedly named a Best Lawyer in America for Mediation and was recently voted 2022 Mediator of the Year for the San Francisco area through U.S. News–Best Lawyers’ rating system. In this episode, Mark draws on his experience as a former general counsel to provide insight into the mind of the general counsel in the context of mediation and, in his discussion with Len, helps you understand what you need to do in mediation when a general counsel is involved in the decision-making process.

Mr. LeHocky’s approach is shaped by having worn nearly all professional hats in the legal arena – as a litigator representing plaintiffs and defendants, a public company general counsel resolving hundreds of litigation matters, a private arbitrator and pro tem judge, and a senior executive and client. Central to all this work is helping decision-makers of all types make realistic, risk-based choices based on alternative scenarios and the practical tradeoffs of different courses. As a mediator, Mr. LeHocky uses all of his varied experience to help craft appropriate resolutions for everyone.

First appointed as a mediator for the federal courts in 1999, Mr. LeHocky’s nationwide mediation practice includes state and federal actions involving Intellectual Property (patents, copyrights, trademarks, and trade secrets), Employment (class and individual cases), Consumer (class and individual cases), Commercial, Antitrust, Unfair Competition and Contract actions, Insurance Coverage and Indemnification disputes, Real Estate transactions, and Business Acquisition and Dissolution disputes.
